Forevergreen - Terms and Conditions

1. Definitions
1.1 "Company" refers to Forevergreen, a trading entity of FGD Partners Ltd.
1.2 "Customer" refers to any individual, business, or entity engaging Forevergreen’s services.
1.3 "Services" refer to the hard landscaping work provided by Forevergreen.
1.4 "Contract" refers to the agreement between the Company and the Customer for the provision of Services.
1.5 "Site" refers to the location where the Services will be performed.
2. Scope of Work
2.1 The Company agrees to provide hard landscaping services as specified in the contract, including but not limited to paving, decking, fencing, driveways, and other external works.
2.2 Any additional work requested outside the agreed scope must be confirmed in writing and may be subject to additional charges.
2.3 The Company reserves the right to refuse work that falls outside its expertise or if conditions on the Site make completion unfeasible or unsafe.
3. Quotations and Pricing
3.1 All quotations are valid for 30 days from the date of issue.
3.2 Prices are subject to change if unforeseen circumstances arise, including material cost fluctuations or changes to the scope of work.
3.3 The Company reserves the right to amend quotations if errors or omissions are discovered after the quote has been issued.
4. Payments and Deposits
4.1 A deposit may be required before work commences. The deposit amount will be specified in the contract.
4.2 Payments must be made in accordance with the agreed payment schedule.
4.3 Final payment is due upon completion of the work. Failure to make payment within the agreed timeframe may result in additional charges and/or legal action.
4.4 The Company reserves the right to cease work if payments are not made as per the agreed schedule.
5. Site Access and Preparation
5.1 The Customer must ensure the Site is accessible and prepared for work to commence.
5.2 The Company is not responsible for delays caused by obstructions, restricted access, or the need to remove obstacles not previously agreed upon.
5.3 Any costs incurred due to delays caused by the Customer will be chargeable.
6. Materials and Supply
6.1 The Company will supply materials necessary for the completion of the work unless otherwise agreed in writing.
6.2 The Company is not responsible for delays in material supply caused by third-party suppliers.
6.3 Any materials supplied by the Customer must be fit for purpose. The Company accepts no liability for defects in Customer-supplied materials and down time will be chargeable if materials supplied by the customer are delayed.
6.4 Natural materials such as stone and timber may vary in colour and texture, and the Company cannot guarantee uniformity.
6.5 Timber products and composite materials may experience natural shrinkage or expansion due to environmental conditions, which is beyond the Company's control.
6.6 Artificial grass installations may, in some cases, show slight visible joins, particularly under certain lighting conditions.
7. Workmanship and Warranty
7.1 The Company guarantees its workmanship for a period of 12 months from the completion date, subject to normal wear and tear.
7.2 This warranty does not cover damage caused by misuse, extreme weather, subsidence, or external factors beyond the Company’s control.
7.3 Any claims regarding defects must be made in writing within the warranty period.
8. Health and Safety
8.1 The Company will comply with all relevant health and safety regulations.
8.2 The Customer must inform the Company of any potential hazards on the Site before work commences.
8.3 The Company reserves the right to suspend work if health and safety risks arise.
9. Liability and Insurance
9.1 The Company holds public liability insurance to cover accidental damage or injury.
9.2 The Company is not liable for pre-existing damage, unforeseen ground conditions, or third-party actions affecting the work.
9.3 The Customer must ensure adequate insurance coverage for the Site.
10. Cancellations and Delays
10.1 If the Customer cancels the contract within 7 days of the scheduled start date, a cancellation fee may apply.
10.2 The Company is not responsible for delays due to weather conditions, supplier shortages, or other factors beyond its control.
10.3 If the Company needs to reschedule work, it will notify the Customer as soon as possible.
11. Complaints and Dispute Resolution
11.1 Any complaints must be submitted in writing within 7 days of the issue arising.
11.2 The Company will attempt to resolve disputes amicably. If a resolution cannot be reached, legal mediation may be pursued.
12. General Provisions
12.1 These Terms and Conditions form part of the contract between the Company and the Customer.
12.2 Any variations to these Terms must be agreed upon in writing by both parties.
12.3 The contract is governed by the laws of England and Wales.
